MARINA RULES & REGULATIONS

Welcome to Seaway Shipyard, Inc. We are pleased to have you and are committed to providing a setting that will make your time here pleasurable. Reasonable and practical precautions will be taken by the Marina to ensure a safe and enjoyable experience. However, the Marina assumes no responsibility for, nor does it guarantee the safety of any boat or person in the Marina. The Marina will not be liable for any personal injury, nor will it in any event be responsible for property damage or loss resulting from ice, wind, storm, fire, theft, sinking, or any other causes.

The Vessel Owner (hereinafter Owner) shall abide by the following rules and regulations while at the Marina. Owner shall be responsible for advising guests, contractors and vendors of these rules and regulations, and Owner shall be responsible for the conduct of Owner’s guests, contractors and vendors while they are at the Marina.

1. SWIMMING & FISHING: For the safety of our customers, swimming, diving, fishing, or fish cleaning is not permitted from the docks, piers or vessels in the Marina. Cleaning of fish on the docks is also strictly prohibited. If you clean fish on your boat, all fish waste is to be removed from Marina property and disposing of fish waste is not permitted in the basin or Marina dumpsters.

2. NOISE: Please use mature judgment in operating engines, generators, radios, audio systems, and televisions so as not to create a nuisance or disturbance to other vessel Owners and/or the occupants of adjoining properties. Excessive loud noise and/or partying anytime of day or night is not permitted. Operation of engines and generators is prohibited between the hours of 10:00p.m and 8:00a.m., except in conjunction with entering or leaving the Marina. All engine exhausts shall be effectively muffled by a muffler or underwater exhaust as required by NY Navigation Law § 44. Loud noises, running on the docks or vessel storage areas, excessive profanity or abusive language or any other activities which Marina, in its sole and absolute discretion, determines to be a general disturbance or public or private nuisance or interferes with the quiet and peaceful enjoyment of the Marina by others, are prohibited. Halyards shall be secured so as to prevent slapping. QUIET TIME 10:00PM- 8:00AM.

3. CONDUCT: We value the community atmosphere of the Marina, and we ask that you conduct yourself accordingly. Disorderly or indecorous conduct that infringes on the quiet enjoyment of other boat owners or which may injure a person, cause damage to property, or harm the reputation of the Marina, shall constitute grounds for immediate dockage cancellation and removal of the individual(s) or boat in question from the Marina. Owners shall be responsible for the conduct of their guests at the Marina and for any damage done by them to the Marina or third parties.

4. PETS: Pets must be leashed at all times, and controlled so that they do not disturb others. Pets are not allowed to relieve themselves on the docks, walkways, or parking areas. Check with the Marina office on approved locations to toilet your pets. Owner shall be required to clean up after their pets and those of their guests. Failure to clean up after your pet shall constitute grounds for immediate rental cancellation and removal of the individual(s) or boat in question from the Marina. Pets are permitted only if they do not disturb other vessel Owners or cause excessive noise.

5. POWER & WATER : Shore power is available at certain locations for use with marine approved 3-wire cord with Marina approved twist lock connections. Please note that any cord set exhibiting frayed or cracked insulation, or other hazardous condition, will be disconnected. Water hookups are available at certain locations. To help conserve water, please fit all water hoses with self-closing nozzles, and address all leaks at hose connections. Seaway Shipyard reserves the right to individually meter electrical and water service and surcharge accordingly.

6. PARKING: Parking is available for boat owners and their guests, in the Marina parking lots, while conducting marina business only. Parking areas and spaces may be designated and limited to automobiles, pickup trucks, mini-vans and motorcycles belonging to Owners. Please do not park in such a way as to block fire lanes, handicap areas, entrances, exits, or Marina fuel tank filling areas. The Marina reserves the right to have vehicles violating these rules towed at the owner’s expense. The Marina will not be liable for damage incurred to a customer’s vehicle while parked on Marina property.

7. REFUSE DISPOSAL: Dumpsters are located adjacent to the Office and are available for use by Marina recreational customers for household-type garbage generated on board or in the yard. No garbage, trash, fish waste or other refuse shall be thrown into the water. All engine oil, bilge oil, flammable substances, human or fish waste and other hazardous or dangerous substances shall be disposed of in proper containers and in compliance with all applicable environmental laws and regulations. Disposing of oils, flammable substances, human and fish waste is not permitted in the basin or Marina dumpsters.

8. SEWAGE DISPOSAL: No sewage shall be pumped into the water. Vessels shall have properly installed, and operational marine toilets as defined by the State of New York and applicable federal regulations and shall use licensed pump-out facilities.

9. FIRE SAFETY: CHARCOAL GRILLS, HIBACHIS AND OPEN FIRES OF ANY KIND ARE STRICTLY PROHIBITED ON OR IN ANY VESSEL, DOCK AND WITHIN THE MARINA PREMISES. Unattended use of electrical equipment, including air conditioning units and portable heaters, aboard your boat is prohibited.

10. SAFETY OF CHILDREN: A responsible adult must accompany children aged 12 and under on the Marina premises at all times. It is strongly recommended that parents have young children and non-swimmers wear personal flotation devices on boats and around docks. The Marina has no recreational facilities for children and parents are expected to know the whereabouts of their children at all times.

11. WATER QUALITY: The Marina is first and foremost committed to maintaining a pleasant setting for you, your guests, and other boaters. To this end, we ask that you help minimize the impact on the marine environment by securing oil-absorbing pads in the bilge to collect leaks, maintaining your boat engine(s) at peak operating efficiency, cleaning up the bilge after servicing, and using the minimal amount of specialty soap for boat washing. Owners shall not fuel vessels in the Marina.

12. COMPLIANCE WITH LAWS: Owner shall comply with all applicable laws, ordinances, Nautical Rules of the Road, and other rules and regulations in the operation of their boat when in the vicinity of, or at the Marina including but not limited to those issued by the U.S. Coast Guard, U.S.E.P.A., and New York State D.E.C. Owner will be required to promptly reimburse the Marina should it incur any cost, penalties or legal expenses because of failure to comply with such laws, ordinances or regulations.

13. APPEARANCES: We recognize that the appearance of the boats in the Marina can enhance your experience. Boats must be kept in such condition as to reflect favorably on the appearance standards maintained by the Marina. The boat deck needs to be kept free of debris, bottles, papers, trash, or unsightly materials at all times.

14. COMMERCIAL USE: Vessels within the Marina shall not be used for any commercial or business activity, including but not limited to, leasing, charter or AirBNB, unless authorized in writing by Marina in advance.

15. SOLICITING: To assure the privacy of others, advertising or soliciting is not permitted anywhere on Marina property.

16. LIVE-ABOARDS: No one shall live aboard any vessel within the Marina without written permission from the Marina.

17. BOAT SLIP: Only one (1) vessel shall occupy a slip at any one time. Tenders and skiffs (a second vessel 10’ or under) shall be stored on the boat. If onboard storage is not practical, tenders or skiffs may be stored alongside the boat with the approval of the Marina. Tenders and skiffs may not be placed on the docks or in slips without Marina approval.

18. SECURING BOAT: Boats in slips shall be secured with bow, stern and spring lines in a safe and secure manner and must have fenders attached to the boat, not the dock, to protect them from rubbing against the dock. The Marina strongly advises that dock line be made of nylon, not polypropylene. We also strongly advise the use of chafing gear lines. If a boat is improperly secured the Marina may, but is not obligated to, secure or retie the boat.

19. FOUL WEATHER: Please check your boat when foul weather is forecast. You are solely responsible for your boat under all weather conditions and shall take all appropriate emergency and/or precautionary measures including properly securing your boat. In the event of the forecast or the actual onset of severe weather, the Marina will attempt, if practical and possible, to provide general preparation and damage prevention services, the costs of which may be prorated over all boats. However, the Marina does not assume any responsibility for protection, nor does it guarantee it will be able to adequately provide general services to all boats in the Marina due to the number of boats and limitations of the Marina staff.

20. EMERGENCIES: In case of emergency, Marina reserves the right enter into/upon boat in order to move it to other mooring places.  In the event Marina deems it necessary to replace inadequate, broken or worn lines, the owner will pay Marina for such lines and the labor to install them. The Owner is solely and individually liable for any damages or loss sustained by reason of broken or worn dock lines and/or failure to secure their boat appropriately. Marina assumes no legal liability or responsibility by reason of this provision.

21. DOCK ACCESS & SAFETY: No machinery, equipment, dock boxes, carpets or any other such items shall be stored upon or attached to the dock, piling or any other part of the Marina. Dock boxes, bumper pads, steps, mooring lines and associated cleats, bolts, and other hardware shall be installed only by Marina or under Marina’s supervision at Owner’s expense. No supplies, materials, accessories or debris shall be left on the walkways or docks, nor shall anyone install or construct any lockers, chests, or similar structures on the docks without prior permission from the Marina. The Marina office must approve all dock steps stored on the piers. Dock lines shall not be tied across walkways or fingers, nor shall bow pulpits or any overhang obstruct walkways.

22. MARINA ALTERATIONS: Docks, pilings, utility systems and all other Marina facilities may not be modified, altered, painted, repaired, or changed in any other way by Owner unless authorized in writing by Marina in advance.

23. MARINA SECURITY: The Marina has a video security system for general area supervision. Please be aware that this system does not provide security for individual boats.

24. CONTRACTOR/VENDOR SERVICES: Outside vendors or contractors are not permitted on the Marina premises without written permission of the Marina management. Such contractors or vendors may obtain permission to work on boats in the Marina subject to certain conditions, regulations, and insurance requirements established by the Marina to protect the Marina and its customers. For the protection of our customers, all contractors must have a work order signed by the boat owner and have insurance in an amount equal to twice the value of the vessel being worked on, together with its contents, and liability insurance coverage no less than $1,000,000.00 before being allowed access to any boat within the Marina. Any outside contractor or vendor not complying with these conditions will be required to leave the premises immediately.
